Welcome to EpicSportus. This website is operated by USBR Trade LLC, a Florida limited liability company, doing business as EpicSportus and the official U.S. distributor of Heroes Brand Sports ("EpicSportus," "we," "us," or "our"). Throughout the site, the terms "you" and "your" refer to the user or customer visiting our website or placing an order.

By accessing or using epicsportus.com (the "Site") and by purchasing any product from us, you agree to be bound by these Terms of Service ("Terms"), including the policies referenced herein. If you do not agree to these Terms, please do not use the Site or place an order.

1. Eligibility

You must be at least 18 years of age, or the age of majority in your state of residence, to make a purchase on the Site. By placing an order, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Products

We sell premium beach tennis and pickleball equipment and related apparel and accessories. We make every effort to display product colors, images, and specifications as accurately as possible. We do not guarantee that your device's display reflects the exact color or appearance of any product. All products are subject to availability, and we reserve the right to discontinue any product at any time.

3. Orders and Acceptance

Your submission of an order is an offer to purchase. All orders are subject to our acceptance and to product availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or limitations on quantities available for purchase. If we cancel an order after payment has been processed, we will issue a full refund to the original payment method.

We reserve the right to limit the quantity of any item purchased per person, per household, or per order.

4. Pricing and Payment

All prices are listed in U.S. Dollars (USD) and are exclusive of applicable taxes unless otherwise stated. Applicable sales tax will be calculated and added at checkout based on the shipping destination.

Prices and promotions are subject to change without notice. In the event a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel any order placed for that product, whether or not the order has been confirmed and payment processed.

Payment is processed at the time the order is placed. By providing payment information, you represent that you are authorized to use the payment method.

5. Shipping and Delivery

Shipping options, costs, and estimated delivery times are presented at checkout and are governed by our Shipping Policy. Title and risk of loss for all products pass to you upon our delivery of the products to the carrier. Estimated delivery dates are not guaranteed, and we are not responsible for delays caused by the carrier or by events outside our control.

6. Returns and Exchanges

Returns and exchanges are governed by our Return and Exchange Policy, which is incorporated into these Terms by reference. Key conditions include:

  • Returns and exchanges are accepted within 30 days of the delivery date, provided items are unused, unwashed, in original condition, with all tags and packaging intact, and accompanied by proof of purchase.
  • We do not accept returns of any item that shows signs of use, wear, or court play under any circumstances. This includes rackets, balls, bags, and apparel with visible marks, dirt, or damage resulting from use.
  • If a returned item is found upon inspection to show signs of use, wear, or court play, the return will not qualify for a full refund. Original and return shipping costs, payment processing and platform fees, and a restocking fee of up to 15% of the item value will be deducted from any applicable refund.
  • The following items are final sale and cannot be returned or exchanged: used or court-tested equipment, customized or personalized items, sale or clearance items, and gift cards.

All returns are initiated through our returns portal at epicsportus.com/returns. By submitting a return, you acknowledge and agree to the terms of our Return and Exchange Policy.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, product designs, and the Heroes Brand and EpicSportus names and marks, is the property of USBR Trade LLC or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

8. Acceptable Use

You agree not to use the Site for any unlawful purpose, to violate any applicable law or regulation, to infringe our intellectual property rights or those of any third party, to submit false or misleading information, to upload or transmit any malicious code, or to interfere with the security or proper functioning of the Site. We reserve the right to terminate your access for any violation of these Terms.

9. Disclaimer of Warranties

The Site and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted, secure, or error-free.

Sporting equipment carries inherent risks. You are responsible for using all products in a safe and appropriate manner and in accordance with any manufacturer instructions.

10. Limitation of Liability

To the fullest extent permitted by law, USBR Trade LLC, its members, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Site or any product purchased. Our total liability for any claim arising out of or relating to these Terms or any product shall not exceed the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless USBR Trade LLC and its members, officers, employees, and affiliates from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
